Donations Policy

The Kenya Red Cross Society (hereinafter KRCS) recognizes the importance of charitable gifts, donations and fundraising in furtherance of its mission to prevent and alleviate human suffering.

With your help through donations, KRCS is able to meet the said mission and vision. We are keen on ensuring accountability to our donors and therefore we have integrated certain policies and guidelines for dealing with gifts, donations and fundraisings for the Society’s programs.

Below, we have highlighted relevant principles from the KRCS donations policy for your easy reference as you proceed to use the donations platform.

Donation defined

For all intents and purposes of the use of this platform, “donation” shall refer to a voluntary contribution in the form of monetary or non-monetary gifts to a fund or cause for which no return service or payment is expected or made.

Purpose of the Platform

The purpose of this platform is to provide a safe and secure means for individuals and organizations that wish to make donations to the Kenya Red Cross Society through our website and webpages. Forms of donation

Gifts and donations may be made to the KRCS in various forms, including but not limited to:

  1. Cash or cash equivalent
  2. Publicly traded securities or shares
  3. Bequests
  4. Life insurance policies
  5. Gifts-in-kind
  6. Charitable remainder trusts
  7. Land / real estate
  8. Gifts of residual interest

Donations which shall not be accepted

The KRCS is grateful for all gifts, donations and sponsorships offered. However, it will not accept gifts that are unlawful or result in an abridgement of its freedom, autonomy and/or integrity. It follows that KRCS reserves the right to decline a gift, donations and sponsorship for any reason in its sole discretion, including but not limited to:

  1. Gift, sponsorships or donations that could reasonably compromise the KRCS public image or reputation;
  2. Gifts, sponsorships or donations that will be difficult or costly to administer;
  3. Gift, sponsorships or donations that exposes the Society to unacceptable risk;
  4. the donor applies unacceptable restrictions or conditions on the gift; and/or
  5. Gifts, sponsorships or donations directly stemming from revenues of activities contrary to the fundamental principles of the Red Cross Red Crescent Movement.

Donation Processing
We accept donations in multiple currencies, including but not limited to Kenya Shillings (KES) and US Dollars (USD). Donations will be processed in the currency selected by the donor at the time of making the donation.

When you make a donation, you agree to the processing of your personal data in accordance with KRCS’s data protection policy and privacy standards. If you make a donation in a currency other than KES, you understand and agree that the donated funds will be converted to KES at the prevailing exchange rate before being used by KRCS.

General guidelines

We shall adhere to the following guidelines while dealing with donations that you make to KRCS:

  1. We shall call for support in a respectful manner and without pressure.
  2. We shall solicit and accept donations in a manner that adheres with KRCS ethics and that upholds respect for donors.
  3. We shall accept unrestricted contribution and assistance in any form.
  4. Donations of Funds shall be made in the name of the KRCS and not in the name of any individual person.
  5. We shall not provide any legal, accounting, tax or financial advice to donors with respect to gifts or donations except where expressly agreed between the parties to be applicable.
  6. We shall not act as an executor of a donor’s estate or as a trustee of a living trust.
  7. We may accept as agent or trustee, funds or property in trust or earmarked for particular use, provided that such use is within the general scope of our activities, purposes and powers. Where changed circumstances makes it impossible for the Society to use gifts or donations for its designated purposes, the Society may at its discretion change the terms of the gift or donation. The Society will attempt to adhere as much as possible to the original intent of the donor.
  8. All third parties not directly affiliated with KRCS who wish to solicit funds on behalf of the Society must acquire written permission from the Society prior to beginning any fundraising activities.
  9. Appropriate discussion and consultation will occur internally prior to approaching or making commitments to donors. Pre-approval of some gifts, donations and sponsorship may be required as determined from time to time.
  10. The Society values its donors and will endeavor to protect donors from multiple approaches for Gifts and donations by different sections of the KRCS.
  11. All solicitation and fundraising materials and other communications to donors and the public shall clearly identify the Society and be accurate and truthful.
  12. To assist in costs associated with fundraising, the Society may charge an administration levy on gifts and donations received. Such costs will be communicated and reported to the donor.
  13. This policy shall not be used to exclude a partner or donor from their obligations under any procurement procedure outlined in the procurement policy

Use of Donations

As a general principle, KRCS will use donations received for the purpose for which they were made.

All donations made to the Society shall have the purpose of donation documented and the Society shall observe the donors’ terms and conditions governing the use of the donation. These terms and conditions may occur during the grant period or after its expiration and may include requirements and conditions for use or disposition of such a donation.

Donation refund and cancellations guidelines

As a general principle, donations are a voluntary contribution in the form of monetary or non-monetary gifts to a fund or cause for which no return service or payment is expected or made. It follows that there can be no refund on donations made to KRCS.

KRCS reserves the right to cancel a donation for any reason, including but not limited to suspected fraud, misconduct, violation of these terms or any other reason contemplated in the foregoing. In the event of such a cancellation, KRCS will notify the donor and issue a refund if applicable.

Record keeping and recognition

  1. KRCS may grant public recognition for gifts and donations and this shall be done whilst taking the donor’s wishes into account.
  2. The KRCS will respect all donor requests for anonymity to the extent legally possible.

User Conduct

Users of this platform agree to the following undertakings:

  1. You agree to use this platform only for lawful purposes and in accordance with these terms
  2. You agree not to use this platform:
  3. in any way that violates any applicable laws and/or regulations;
  4. in any way that infringes on the rights of others; and/or
  5. to engage in any conduct that is harmful, offensive, or disruptive to the platform or others using the platform.

Limitation of Liability

  • KRCS will not be responsible for any direct, indirect, incidental, consequential, or punitive damage or losses resulting from the use of this platform.  
  • KRCS will be not be responsible for any damage and/or losses incurred as a result technical malfunctions, interruptions and/or errors that may occur while using this platform.
  • KRCS will not be responsible for the content, accuracy and/or reliability of any third-party websites linked to or from this platform.

Intellectual Property

All content on this platform, including text, graphics, logos, and images, is the property of KRCS.

Amendments and non-retroactivity

KRCS may from time to time without notice amend these terms to reflect our current practices and applicable legal requirements PROVIDED ALWAYS that the applicability of new terms shall be from the date they are uploaded on the website.  By continuing to use this platform, you agree to be bound by any such amendments.

Governing Law

These Terms are governed by and construed in accordance with the laws of Kenya. Any disputes arising out of or in connection with these terms shall be resolved by courts of competent jurisdiction in Kenya.

By using this platform, you acknowledge that you have read, understood and agree to be bound by these Terms and KRCS’s privacy policy.

This policy shall take into account the following policies of the KRCS: Anti-Corruption and Fraud policy, Whistle Blower Policy, Conflicts of Interest policy, Procurement Policy and Code of Ethics.
